Terms of Service

These Terms of Service ("Terms") govern your use of the Sunflower mobile application (the "App") and any associated hardware monitoring devices (the "Hardware"), collectively referred to as the "Services," operated by Stellar Tech LLC ("we," "our," or "us"). By downloading the App or purchasing/using the Hardware, you agree to these Terms. If you do not agree, do not use the Services.
1. Use of the Services
The Services are provided for personal use to monitor and review your solar device performance. You agree not to misuse the Services, reverse-engineer the Hardware or App, or use them for any unlawful purposes.
2. Hardware Sales and Shipping
- Purchases: All orders for Hardware are subject to availability. We reserve the right to refuse or cancel any order for any reason.
- Shipping & Risk of Loss: Title and risk of loss for the Hardware pass to you upon our delivery to the carrier. However, every shipment includes up to $100 of carrier insurance. In the event that your package is lost or arrives damaged, we will gladly ship you a replacement as soon as the carrier confirms the issue. Because carriers require specific evidence to process claims, you agree to assist us in this process by providing necessary details (such as photos of the damaged device and packaging) to our support team within 7 days of delivery.
- Returns: Hardware may be returned within 30 days of delivery, provided it is in its original condition and packaging. You are responsible for all return shipping costs unless the device is confirmed defective by us. Please note that a $10 shipping and processing fee will be deducted from your total refund.
3. Hardware Setup and Safety
- User Responsibility: The Hardware is designed as a simple, plug-and-play monitoring add-on. You are solely responsible for plugging in and setting up the Hardware in accordance with the provided instructions.
- Safety & Environmental Restrictions: The Hardware is designed for indoor use only in dry locations. To prevent damage, malfunction, or safety hazards, ensure the device is:
- Kept away from water, moisture, or high-humidity environments (it is not waterproof).
- Kept away from open flames or extreme heat sources.
- Positioned out of prolonged direct sunlight, which can cause excessive heat buildup.
- No Liability for Damage: Stellar Tech LLC is not liable for any damage to your property, solar panels, inverters, or electrical systems resulting from improper installation or use of the Hardware.
4. App Store and Google Play Subscriptions
The App offers monthly and yearly subscriptions with a 3-day free trial for new users.
- Billing and Management: All subscriptions are processed exclusively through the third-party platform operator where you downloaded the App (either the Apple App Store or Google Play Store). You must manage, cancel, or request refunds for your subscription directly through your respective Apple or Google account settings.
- Platform Terms Apply: By subscribing, you agree to comply with the respective subscription terms, billing policies, and user agreements of Apple or Google. We do not handle billing transactions, process refunds, or resolve subscription payment disputes.
5. Data Collection
By using the Services, you consent to the collection of solar performance data, energy generation metrics, and hardware diagnostic information (e.g., MAC address, firmware version). This data is used to provide insights and enhance service functionality. All data collection is governed by our Privacy Policy.
6. Intellectual Property
All intellectual property rights in the App and Hardware, including firmware, software, design, and content, are owned by Stellar Tech LLC. You are granted a limited, non-exclusive license to use the Services according to these Terms.
7. User Responsibilities
You are responsible for ensuring your device and network connection are secure. You must not attempt to access any system or data not intended for you or interfere with the App's normal operation.
8. Limited Warranty and Disclaimer
- Hardware Limited Warranty: We warrant that the Hardware will be free from manufacturing defects for a period of one (1) year from the date of purchase. This warranty does not cover damage caused by accident, misuse, unauthorized modification, or improper installation.
- Disclaimer: Except for the limited warranty above, the Services are provided "as is" and "as available." We make no guarantees that the Services will be error-free or that data displayed will be 100% accurate or uninterrupted. Use the Services at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages — including, without limitation, loss of profits, data, or equipment — arising out of or related to your use of the App, even if advised of the possibility of such damages.
Our total liability to you for any claim shall not exceed the amount you paid for the Hardware or the subscription fees paid during the past twelve (12) months, whichever is greater.
10. Termination
We may suspend or terminate your access to the App for violations of these Terms. You may cancel your subscription at any time via your respective Apple or Google Play account settings.
11. Changes to Terms
We may update these Terms at any time. Updates are effective when posted in the App or on our website. Continued use of the service constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of California, U.S. Disputes shall be resolved exclusively in the courts of California, U.S.
